Following the announcement of a joint streaming service by the firms, FuboTV filed a lawsuit against them.
FuboTV, a streaming company that focuses on live sports, has launched an antitrust complaint against Disney, Fox, and Warner Bros. Discovery. The lawsuit accuses the three firms of orchestrating “a years-long campaign” to hinder FuboTV’s business. The lawsuit filed by the corporation is expected to be filed soon. ESPN, Fox, and Warner Bros. Discovery, all of which are owned by Disney, have announced that they would be launching a sports streaming service in the autumn of 2024. This service will provide users with access to sporting events that are shown on the networks that they operate. According to the complaint filed by FuboTV, the firms are taking its playbook, and the launch of their joint venture will undermine competition and lead to price inflation for customers. FuboTV also alleged that the companies are stealing its playbook.
According to FuboTV, the introduction of the defendants’ streaming service is only “the latest coordinated step” in their “campaign to eliminate competition in the sports-first streaming market” and in their endeavour to obstruct its operation. FuboTV also claimed that the defendants are attempting to block its business. According to the streaming service, the defendants charge it content licencing prices that are thirty to fifty percent higher than the rates that they charge other distributors. As an additional requirement for licencing their programming, it is stated that they compel FuboTV to bundle “dozens of expensive non-sports channels” that “customers do not want” with their sports offers. FuboTV noted that all of these factors contribute to an increase in the costs that it must pass on to its customers.
Additionally, FuboTV asserted that the firms in question have stopped it from being able to provide streaming items that its members would like to have access to, including programming that is available on Hulu. It is also alleged that the defendants place a restriction on the number of subscribers who are able to purchase their content bundle. This restriction is designed to prevent FuboTV from making a significant impact on the market.
“Each of these companies has consistently engaged in anticompetitive practices that aim to monopolise the market, stifle any form of competition, create higher pricing for subscribers and cheat consumers from deserved choice,” FuboTV CEO David Gandler stated in a prepared statement. We are of the opinion that these firms are creating insurmountable obstacles that will effectively prevent any new competitors from entering the market. This is because they have joined forces to exclusively reserve the rights to offer a specialised live sports package. This method assures that consumers who are looking for a dedicated sports channel selection are left with no other option but to subscribe to the joint venture that the defendants have established.
